Imposter Patriotism

American Flag Utility KiltI discovered this American Flag Utility Kilt online. It is oh so guady and gauche. But there will surely be some ignorant schmuck who thinks it patriotic. Yeah, how very American to fart on the flag. It also violates federal law (4 U.S. Code §§1-10).

On the heels of WWII, Congress enshrined the historic and military flag practices in federal law. As stated in 4 U.S. Code §8(d) and §8(j): “the flag should never be used as wearing apparel, bedding, or drapery” and “no part of the flag should ever be used as a costume or athletic uniform.”

However, the First Amendment protects Americans’ right to desecrate the flag in the name of free speech. Therefore it is not constitutional to prosecute violations of the symbol which represents the nation born from that constitution.

My question for all the asshats who wear flag bikinis and flag kilts is this: Is it your intent to disrespect the flag or to honor the flag? If you disrespect it, you cannot honor it. If you honor it, you will not disrespect it.

I emailed these points to the manufacturer’s customer service whereupon I discovered that it was a Pakistani distributor. I doubt they will care. Foreigners respect American dollars more than Americans respect the flag. How very American.

Pursuant to 4 U.S. Code § 8, “(d) The flag should never be used as wearing apparel, bedding, or drapery” and “(j) No part of the flag should ever be used as a costume or athletic uniform.” Your American Flag Utility Kilt is therefore illegal. However, the First Amendment protects Americans’ right to desecrate the flag in the name of free speech and therefore itbis not possible to prosecute violations. So is it your intent to disrespect the flag? I think you should cancel the product and add an explanation on the product page.
